Mesh Trial Has Been Delayed — What Can Plaintiffs Do?

The multidistrict litigation (MDL) against Ethicon, a division of Johnson & Johnson, was scheduled to begin in November. The MDL includes around 33,000 cases in which women are suing the manufacturer for defective transvaginal mesh and bladder sling devices, but the number of cases has not served to expedite matters. Now the mesh trial has been delayed as the presiding judge continues to make alterations.

Why Is The Trial Being Delayed?

U.S. District Judge Joseph Goodwin has decided to delay the trial due to new information that has come to light while preparing for the November start date. New evidence shows that some of the victims in this lawsuit were implanted with multiple transvaginal mesh devices, which probably contributed to their complications. Plus, new plaintiffs have joined the trial.

The first trial was scheduled to review 26 claims against Ethicon, but now that claim number has risen to 39. The new trial date set by Judge Goodwin is December 7th, and many experts are worried about the pressure that this could put on the victims of these potentially defective devices.

This MDL has stretched from February of 2012 all the way to now.
